Terms and Conditions

These Terms & Conditions explain our booking policies, delivery timelines, licensing, payment requirements, and client responsibilities.
By booking or purchasing services from Wendell & Anthony Media, the client acknowledges and agrees to these Terms and Conditions.

I. Scheduling

A. Booking Appointments

All listings should be scheduled online or by phone. Online booking is the preferred method, as it provides real-time calendar availability. If we are unavailable by phone, you may be directed to our online booking portal. Once an order is submitted, it will be confirmed within a few hours.

If your preferred date or time is unavailable, please contact our team—we do our best to remain flexible when possible.

B. Arrival Window

On the day of your shoot, our photographers aim to arrive up to 10 minutes prior to the scheduled start time. In rare cases, circumstances outside of our control, including traffic, prior appointments, weather, or similar conditions, may cause delays. If this occurs, you will be notified by call or text with an updated arrival time.

II. Rescheduling & Cancellations

A. Notice Requirements

Appointments may be rescheduled or canceled with at least 24 hours’ notice. Clients may reschedule directly through their online dashboard or by contacting our team via phone, text, or email.

B. Cancellation Fees

There are no fees for rescheduling or canceling with at least 24 hours’ notice.

Appointments canceled or rescheduled less than 24 hours before the scheduled start time are subject to a $95 cancellation fee, which will be invoiced directly.

If our photographer arrives at the property and the appointment cannot be completed, a $125 on-site cancellation or rescheduling fee applies.

III. Preparation for Photoshoots

A. Property Readiness

Proper preparation is critical to achieving the best results. We strongly recommend following the preparation guide available on our website.

The client is responsible for ensuring that the property is reasonably prepared and ready for photography, video, floor plans, 3D tours, drone services, and any other media ordered.

B. On-Site Adjustments

Our photographers may make minor adjustments on-site when reasonably necessary; however, not all items can or will be moved.

Failure to properly prepare the property may result in unwanted items appearing in photographs, videos, floor plans, 3D tours, or other media.

Additional editing, object removal, return visits, reshoots, or other corrective work resulting from property condition or preparation may be subject to additional fees.

IV. Delivery

A. Standard Delivery

Most media is delivered the next morning by 11:00 AM, allowing clients time to activate their listings quickly. Same-day delivery may be available for an additional fee.

B. Delivery Timelines

Next Morning, before 11:00 AM:

  • HDR Photos

  • Drone Photos

  • 3D Tours, including Zillow 3D and Matterport

  • Virtual Twilights

  • Listing Websites

Within 36 Hours:

  • Virtual Staging

  • Basic & Plus Floor Plans

  • Standard Videos and Reels

Within 2–3 Business Days:

  • Premium Videos

  • Videos with AI Enhancements

  • 2D Color and 3D Floor Plans

  • 3D Render Floor Plans

Delivery times begin after the appointment is completed.

Large properties or services requiring outside vendors, specialty processing, AI enhancements, premium editing, render floor plans, or similar production may require additional processing time.

Delivery timelines are estimates and may vary slightly due to production volume, weather, vendor processing, technical issues, special requests, or other circumstances outside of our reasonable control.

V. Travel Fees

A. Service Area

Travel outside of our standard service area may incur an additional fee. Please contact our team with the property address for a quote.

B. Mileage Rate

Travel fees are calculated at $0.75 per mile, round trip, outside of our standard service area unless another travel fee has been quoted or agreed upon.

VI. Licensing & Usage Rights

A. Copyright Ownership

Wendell & Anthony Media retains full copyright ownership of all media produced and may use the content for marketing, portfolio, promotional, educational, training, or other business purposes.

B. Client Usage License

The original purchasing real estate agent or broker receives a limited, non-transferable license to use the media for the following purposes:

  • Property Marketing: To advertise and market the specific property during the agent’s active listing period.

  • Ongoing Personal Marketing: To use the media indefinitely for the agent’s own personal branding, portfolio, website, social media, presentations, printed marketing materials, advertising of their real estate services, awards, achievements, past-sales promotion, and other self-promotional purposes, even after the property is no longer actively listed.

The expiration, cancellation, withdrawal, sale, or transfer of the property listing does not terminate the original purchasing agent’s right to use the media for their own personal marketing and self-promotion.

However, once the original listing period has ended, the media may not be used to actively market, advertise, or re-list the property for sale or lease without a new property-marketing license or a new media order.

This license belongs exclusively to the original purchasing agent or broker and may not be transferred, assigned, sublicensed, sold, or provided to another agent, property owner, landlord, brokerage, property manager, builder, or other third party for that party’s use without written authorization from Wendell & Anthony Media.

C. Third-Party Use

Media may not be sold, transferred, shared, or provided to another agent, property owner, landlord, brokerage, assistant, staging company, property manager, builder, or other third party for that party’s use without written permission from Wendell & Anthony Media.

Additional licensing may be purchased when another party wishes to use the media.

Requests for commercial, builder, marketing, advertising, property-management, or other use beyond the original client’s license may require additional licensing.

VII. Payment

A. Payment & Preview Access

Payment is due upon delivery of completed media and no later than seven (7) days after delivery.

Clients may be provided with preview access to verify that services were completed and to identify legitimate quality concerns before downloading the media.

Preview access is not a trial period, approval process, or opportunity to cancel, reduce, renegotiate, or selectively purchase completed services.

Clients are purchasing the professional services required to produce the requested media. Once those services have been completed, payment is owed regardless of whether every image, video, floor plan, tour, or other deliverable is ultimately downloaded, used, or published.

By placing an order, the client authorizes Wendell & Anthony Media to charge the credit card on file for any unpaid balance after the seven-day payment period unless other payment arrangements have been made in advance.

Download access is released after payment has been received. Wendell & Anthony Media reserves the right to suspend download access, future booking privileges, and other account privileges until outstanding balances have been paid in full.

Clients with legitimate quality concerns should notify us promptly. We are committed to working with our clients to resolve reasonable editing or production issues whenever possible. Quality concerns do not relieve the client’s obligation to pay for completed services.

B. Final Delivery Adjustments

Final invoices are based on the services and deliverables actually completed. While every effort is made to fulfill the order as requested, adjustments may be necessary to properly complete the assignment or to accurately reflect the services provided.

Whenever reasonably practical, clients may elect to remain within their original order by reducing optional deliverables, such as additional photographs. Any removed or unpaid media is not licensed for use and may not be published, distributed, or otherwise used.

Some adjustments cannot reasonably be declined after production has been completed. These include, but are not limited to:

  • Video runtime necessary to adequately showcase the property’s size, layout, requested features, or agent participation.

  • Floor plan upgrades or overages based on the property’s actual measured area, number of levels, labeling requirements, or requested floor plan features.

  • Additional production resulting from incomplete, unclear, conflicting, or untimely client instructions.

  • Work reasonably necessary to produce a complete and professionally marketable final product.

Client-Selected Service Limitations

If the ordered media package does not reasonably allow for comprehensive coverage of the property, Wendell & Anthony Media will produce the highest-quality media reasonably achievable within the scope of the package purchased.

Depending on the property’s size, layout, complexity, and features, shorter video durations, smaller photo packages, or other limited services may emphasize the property’s most important highlights rather than provide comprehensive coverage.

The completed media will be evaluated based on the scope of the package ordered, not on whether every room, feature, amenity, angle, or requested detail is included.

Dissatisfaction resulting solely from the limitations of the package ordered does not constitute a production defect and is not, by itself, grounds for a refund, complimentary reshoot, additional editing, or additional coverage.

Optional add-on services will not be added without the client’s approval. However, necessary adjustments resulting from the property’s actual characteristics, the completed scope of work, or insufficient client direction are not considered discretionary add-ons and will be billed at the applicable rate.

Clients who require a strict photo count, video duration, budget, or other service limitation should communicate those requirements before the appointment. Whenever reasonably practical, Wendell & Anthony Media will make reasonable efforts to accommodate those requests.

VIII. Property Access and Readiness

The client is responsible for ensuring that the property is accessible and ready at the scheduled appointment time.

This includes providing accurate access instructions, securing pets, notifying occupants, obtaining any required permissions, and ensuring that the photographer can safely and reasonably access the areas necessary to complete the ordered services.

Delays, restricted access, occupants preventing photography, unsecured animals, incorrect access information, or inability to enter or photograph the property may result in delays, reduced coverage, rescheduling, or applicable cancellation or return-trip fees.

IX. Weather, Safety & Service Limitations

Outdoor, aerial, and certain specialty services are subject to weather, airspace restrictions, property conditions, equipment limitations, legal requirements, and safety considerations.

Wendell & Anthony Media may modify, postpone, discontinue, or decline any portion of an appointment when conditions are unsafe, unlawful, technically impractical, or prevent satisfactory results.

Certain services, including drone photography and video, may not be completed when airspace restrictions, weather, property location, safety conditions, or other operational limitations prevent lawful or safe operation.

When reasonably possible, affected services may be rescheduled, substituted, or completed at another appropriate time.

X. Revisions, Reshoots & Client Requests

Requests involving editing errors, technical defects, or media that does not meet the specifications of the ordered service will be reviewed and corrected when appropriate.

Requests resulting from property condition, missed preparation, weather, staging changes, changes made to the property after the appointment, client preference, additional requested coverage, or information not provided before the appointment may require an additional editing, revision, travel, or reshoot fee.

A difference in personal preference does not necessarily constitute a production defect when the media otherwise meets the scope and specifications of the service ordered.

Wendell & Anthony Media will make reasonable efforts to address legitimate concerns while also distinguishing between production corrections and requests for additional or changed services.

XI. Taxes and Additional Charges

Applicable sales taxes, travel fees, upgrade charges, licensing fees, cancellation fees, overage charges, and approved additional services will be included on the invoice as required.

Taxes are based on the applicable transaction and service location and cannot be removed when legally required.

Additional charges resulting from the actual scope of work, property size, production requirements, client-requested changes, or services completed beyond the original order may also be added when applicable.

XII. Refunds and Charge Disputes

Because our services involve reserved appointment time, professional labor, customized production, editing, digital media creation, and vendor costs, completed services and delivered media are generally non-refundable.

Clients should contact Wendell & Anthony Media promptly with any billing or service concern so that the matter can be reviewed and addressed.

Initiating a chargeback or payment dispute does not cancel the client’s payment obligation for services that were properly ordered and completed.

Wendell & Anthony Media reserves the right to provide supporting order records, communications, appointment records, delivery information, licensing terms, and other relevant documentation in response to a payment dispute.

Nothing in these Terms prevents Wendell & Anthony Media from issuing a refund, credit, complimentary correction, reshoot, or other accommodation when the company determines that doing so is appropriate.
